Welcome to Omaroon. These Terms of Service ("Terms") govern your access to and use of the Omaroon PKU healthcare platform, website, mobile applications, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
Please read these Terms carefully before using our Services. If you do not agree to these Terms, you may not access or use the Services.
Acceptance of Terms
By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
You must be at least 18 years old to create an account. Parents or legal guardians may create accounts on behalf of minors with PKU for the purpose of managing their healthcare.

THE OMAROON PLATFORM IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
- The Services are designed to assist in PKU management but do not replace the judgment of healthcare professionals
- Always consult your physician or qualified healthcare provider with questions about your medical condition
- Never disregard professional medical advice or delay seeking it because of information provided through our Services
- In case of a medical emergency, call your local emergency services immediately
- The phenylalanine readings provided by our devices should be used as part of a comprehensive care plan supervised by healthcare professionals

- Integration with Omaroon PKU monitoring devices
- Healthcare provider tools for patient management
User Accounts and Responsibilities
Account Security
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized access to your account
- You are responsible for all activities that occur under your account
- We recommend enabling multi-factor authentication for enhanced security
Accurate Information
- You agree to provide accurate, current, and complete information
- You agree to update your information to keep it accurate and current
- Providing false or misleading information may result in account termination
Acceptable Use Policy
You agree NOT to:
- Use the Services for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of the Services
- Transmit any viruses, malware, or other harmful code
- Impersonate any person or entity or misrepresent your affiliation
- Collect or harvest any information from the Services without authorization
- Use the Services to send spam or unsolicited communications
- Attempt to reverse engineer or decompile any part of the Services
- Share your account credentials or allow others to access your account
- Use the Services in any way that could harm patients or compromise healthcare delivery
Additional Terms for Healthcare Providers
If you are a healthcare provider using our Services:
- You represent that you are a licensed healthcare professional in good standing
- You agree to use the Services in compliance with all applicable healthcare laws and regulations
- You are responsible for obtaining appropriate patient consent for use of the platform
- You agree to maintain the confidentiality of patient information in accordance with HIPAA
- You acknowledge that clinical decisions remain your professional responsibility
Intellectual Property
All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, software, and compilation thereof, are the exclusive property of Omaroon or its licensors and are protected by United States and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Services for their intended purpose. This license does not include the right to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information obtained from the Services.
Disclaimers and Limitations of Liability
DISCLAIMER OF WARRANTIES: THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMAROON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICES.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages, so some of the above limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless Omaroon, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Services, your violation of these Terms, or your violation of any rights of another party.
Termination
We may terminate or suspend your account and access to the Services at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us.
Upon termination, your right to use the Services will immediately cease. We will retain your health information as required by applicable medical record retention laws. You may request a copy of your data before account termination.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in Orange County, California.
You agree to attempt to resolve any disputes informally by contacting us before initiating any formal legal action.
Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Services.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
